Money Talks Most savvy investors know that the stock market experiences both bull and bear markets. Clearly there are times when small stocks outperform large stocks, or when growth stocks outperform value stocks. However, there are also times when the opposite of each of these occurs. The problem is that market cycles have proven to be inherently unpredictable, making it next to impossible to be consistently successful at market timing on a long-term basis.
Abstract We form portfolios based on firm book-to-market equity ratios and apply stochastic dominance tests. Value (high bookto-market) portfolios dominate low book-to-market portfolios. Thus, value stocks are not rationally priced by the market and the book-to-market ratio is not an efficiently priced proxy for equity risk. But many costly annulments could be avoided if alternative and less hostile means of separation were explored first, new research suggests. Sir Paul says his experience of seeking a divorce - which has included mediation - is like “going through hell”. In an interview with Radio Times, published today, the former Beatle, 65, adds: “As Winston Churchill once said, If you are going through hell, keep going! The only solution is to remain dignified. If I dont keep a silence about it, I lose this idea of being dignified.” The NAOs research implies that solicitors are costing the public purse up to 10m a year by putting profits before their clients interests. Under the legal aid system, solicitors can expect to be paid much more in fees if their case is settled in court. In a third of cases examined by the NAO, lawyers had failed even to suggest that a client seeking a divorce or separation should first consider mediation as alternative to court. The Legal Services Commission (LSC), which authorises legal aid payments, spends about 300m a year helping those who qualify for state funding to deal with a family breakdown.

(Bloomberg) — Sunglass Hut International, the worlds largest sunglasses retailer, said it closed 149 stores because they were unprofitable or werent meeting expectations and will close as many as 76 more by the end of January. Sunglass Hut has three stores in Oklahoma City. Sunglass Hut now operates 2,003 outlets worldwide, including kiosks and stores in malls and free-standing stores, which sell popular sunglasses brands like Oakley, Revo and others. Sunglass Hut also has 107 Watch Station stores, several of which are among the stores being closed in the fiscal year, Gargano said. “All the stores (being closed) are underperforming or unprofitable sites,” Sunglass Hut spokeswoman Lauren Gargano said. The company said its loss for the third quarter ended Oct. 31 narrowed to $4 million, or 8 cents a share, from $5.1 million, or 9 cents, a year earlier. Sales were little changed, rising to $122.8 million from $122.4 million.

Appraisers face new federal licensing laws In the wake of the savings and loan debacle, real estate appraisers dealing with federally guaranteed transactions will be required to have a license or certificate in order to appraise real estate after July 1. The Financial Institutions Reform, Recovery and Enforcement Act has issued an advisory subcommittee, made up of staff from various federal regulating offices, to monitor the states development and implementation of appraisal reform legislation.
When you meet people like Robert Von Ancken, its hard to understand how they find enough hours in the day for all the work they do. Von Ancken, who serves as an executive managing director of the metropolitan valuation and consulting practice with Grubb Ellis, does appraisals for such projects as the World Trade Centec, the Farley Post Office and the West Side Rail Yards during the day, then goes home to run his own acquisition and disposition business. There were few engineering jobs available when he graduated, so he decided he would give real estate a try. However, just weeks after he started as office leasing canvasser with Julien Studley, Von Ancken was called to active duty by the U.S. Army Reserve and his plans fell through once again. After a year of Army service in Panama, Von Ancken came back to New York and enrolled in the graduate real estate program at City University.

And for men, unfurling a slimy, unerotic condom defeats the most erotic of moments. Now, apparently, its all over. We can enjoy a 95 per cent reliable, sex-friendly, over-the-counter contraceptive kit. The boffins at Unipath, who have developed Persona over the past 15 years with more than 1,200 women involved in case studies, are gushing with delight over their new product. Persona is the first time computers have been applied to contraception and the monitor is a sophisticated little system. It identifies two hormones in urine which give the most reliable warning of the fertile period, and compiles the information on to a database. However, it is not suitable for women with irregular periods which fluctuate for more than 10 days. A woman risks pregnancy between six and 10 days a month but contraception methods are used continuously. After three months Persona pinpoints these fertile days. Its a device tailor-made for the 1990s independent woman in a long-term relationship who wants to know more about her body and control her contraception. Revolutionary it is. Not only is it an advance into computer technology, its also thrust contraception onto the market place. Its expensive - pounds 49.95 for a starter pack, pounds 9.95 a month from then on - and is not available on the NHS. Women who do not suit the Pill, IUD, or hate the condom will, hopefully, have lots of cash. “Its up to the Government as to whether it goes on the NHS,” says Keith May, vice-president of research at Unipath. “I would be delighted if Persona was on the NHS, I hope it can be made more widely available, but its not under our control.” So whose control is it under? “The manufacturing company has to apply for a listing on the NHSs Drug Tariff and then it is considered,”says Martin Richards from the Department of Health. Anne Weyman, chief executive of the Family Planning Association illuminates. “The NHS tries to resist things which are expensive. The Pill costs between 60p and pounds 3 a packet, its a very cheap form of contraception. The Government is going more for medicines being available over the counter. Some argue that this is part of a policy of making things more accessible, others that it is shifting the burden of money to the individual,” she explains. “Family Planning Clinics should be able to offer a total range of contraception. Family Planning Clinics at least should be able to get hold of it.” But what of the good old rhythm method, recently heralded as being the most reliable form of contraception? “You have to be taught how to use it, and must be highly motivated to keep it up,” says Anne Weyman. “You have to monitor your temperature, vaginal mucus and changes in the breasts. It takes more effort and its very complicated.” Professor Bob Snowden, a specialist in Reproductive Behaviour who conducted the research, thinks the device will at last involve partners. “With Persona, men can become involved in decisions about when to and when not to have sex.” However, Professor John Guillebaud, Director of the Margaret Pyke Centre is less convinced. “It wont work with people who dont have a very good relationship,” he comments. “Ive heard the most common traffic offence among men is driving through a red light. Acupuncture as a therapeutic intervention is widely practiced in the United States. An estimated 15 million Americans have undergone acupuncture, and about five million undergo the treatment each year. People may find the procedure painless, although some points in some patients may be quite sensitive. Depending on your practitioner, the needles may be twirled or warmed. There are many state acupuncture organizations, and many states also have acupuncture regulations and codes. Almost every state has a State Acupuncture Board, and there are more than 50 accredited schools of acupuncture in the U.S. Widely practiced around the world, especially in Asia (the practice originated in China) and Europe, acupuncture didnt gain a notable following in the U.S. until the 1970s, after President Richard Nixons visit to the Peoples Republic of China. James Reston, a member of the press corps accompanying Nixon, also piqued public interest when he wrote about how physicians in Beijing eased his post-surgery abdominal pain with needles. Acupuncture has been gaining popularity in the U.S. ever since.
Acupuncture is considered a form of treatment or therapy. However, acupuncture practitioners believe that acupuncture may be most successful when it is applied as an early intervention for symptoms or conditions. It may be that acupuncture can prevent some symptoms and conditions from becoming worse or chronic. To date, two studies have shown a positive effect in preventing breech births among pregnant women. More research is needed to define the preventive value of acupuncture.

Colorado Springs-area home construction continued its blistering pace in the first quarter, although one economist fears an oversupply could drive down prices in the next few years. Single-family home building permits totaled 1,392 from January through March — a 20.2 percent jump from the same period last year, according to figures released Friday by the Pikes Peak Regional Building Department. The number of permits this year puts Colorado Springs and El Paso County on pace to shatter the record of 5,059 single-family permits, set only last year.

Since the last PWC article on software two years ago, many programs have become more user friendly, and software developers have expanded the capabilities of some of their previous offerings based on user feedback. “If you did an estimate using just an electronic calculator and did all the calculations that Expert Estimator does for you, youd go out of business, because it would take a week to do every estimate.” So says Dean Johnson, who set out to develop user friendly software that you can adapt for your individual type of business. Johnson is currently in the process of updating Expert Estimator 2.1, including cosmetic changes that make it easier to use, but the big news is that a totally new release, Expert Estimator 3.0, is scheduled for this summer.

The first part deals with the domestic role of monetary policy and the progressive elaboration of a coherent central banking policy in Canada. This part starts with a historical account of the role of the Central Bank of Canada since its creation in 1934. Then, the author develops an interesting chapter about the proper role of a central bank for financial stability by looking at the Canadian experience regarding bank supervision, settlement management, systemic and liquidity crises, and the lender-of-last-resort operation. The Central Bank of Canada never has been directly involved in the supervision of banks, and John Crow is rightly unhappy with this situation: “The Bank and what it knows cannot be ignored in supervisory decisions regarding financial institutions” (p. 77). The second part of the book analyzes the Canadian experience concerning foreign affairs. The most interesting part concerns exchange rate matters. Canada has a long tradition of a flexible exchange rate regime. The author shows the importance of communicating with financial market actors to limit disruptions in the exchange rate, but he also recognizes that the willingness to be transparent can lead “to confusion instead of clarity” (p. 120).

Magnet therapy has been around for centuries in China, India, Egypt, and Greece. In more recent years it has spread west to some European countries, but in North America it is still regarded as alternative medicine (and is one of the therapies being studied by the National Institutes of Health). There is extensive foreign literature on magnet therapy for pain relief and while the quality of the research varies widely, some studies look good. There have been only a few published studies in the United States. One from Baylor College of Medicine in Houston showed that magnets were more than twice as effective as placebos in treating post-polio, muscular, and arthritic-like pain. Another study from New York Medical College showed good results using magnetic shoe inserts to treat diabetic neuropathy (foot pain some diabetics suffer). Although some US, doctors believe there may be something valid in the use of magnets, many remain legitimately skeptical. American physicians generally want a good, solid base of randomized, double-blind, placebo-controlled, multi-center trials clearly demonstrating effectiveness and safety before recommending a therapy to their patients. Even if risks are not a concern (which seems to be true for magnets) the expense can be significant, and even more important, proven treatments may be passed over for an ungrounded hope. There are many traditional medical therapies that are well accepted by the American medical establishment and yet are not fully understood. Still, it is always nice to have a hunch how a therapy works. Theories abound for magnet therapy, but so far any possible mechanism remains to be proved. There is no shortage of anecdotal claims of success. Anecdotal claims do not constitute conclusive scientific proof, but the absence of side effects or prohibitive cost, lead many people with chronic pain to give it a try.

The most valuable sale of Impressionist and modern art ever staged in Britain is to take place in London on Monday. Simon Shaw of Sothebys said: “London was very much eclipsed by New York during the 1990s. Now were seeing that reversed.” In terms of the quality and range of the works consigned for sale “this looks very much like a New York sale”, he said. “Although were not equal with New York, the balance is shifting very significantly. Five or six years ago we were rarely selling $10m pictures. Now were selling quite a few.” The most expensive work is Jeanne Hebuterne (Au Chapeau) by Amedeo Modigliani, expected to make up to pounds 12m. Other works include La Sortie du Bain by Edgar Degas, a pastel dating from around 1895. Paintings by Pablo Picasso include Le Peintre et son Modle, estimated at up to pounds 7m and Les Courses Auteuil, from the start of his career in 1901, estimated at up to pounds 2.5m. There are also works by Raoul Dufy, Camille Pissarro, Alfred Sisley and Gustave Caillebotte.

As your new president, I face a challenging task when it comes to speaking to you about school finance. Let me give you my dilemma. It is the end of the school year as I write this piece and I am reflecting on the uncertain state of school finances in coming months and what these financial challenges mean for us as school system leaders. You will share my frustration that as many as half the nations students may be directly shortchanged of the education they deserve, with the remainder not immune to the impact of belt tightening. As bad as that news is, last year at this time NCSL found 36 states with budget gaps. On the other hand, NCLB and IDEA could be funded retroactively, which would help make up for last years budget shortfalls that resulted from unfunded or underfunded mandates. If you are a school leader in one of the rare districts whose state legislature decided this summer to support quality education with adequate funding for all your schools, the future must look bright, so you can skip the remainder of this column. If youre not in that sunny camp, please continue and let me share my thoughts.

One morning in October, Mike McGee stopped to inspect the Coca- Cola vending machines that he had installed in a new student recreation center at Harvey Mudd College in Claremont, Calif. “Back in the old days, they came around here saying, `Sell our product,” recalled McGee, whose father started the business in 1961. “Now that we need their product, they say, `Well still sell it to you, but were also going to be in business against you.” So McGee pulled his machines from Harvey Mudd, just as he took machines out of nearby Scripps College and two accounts serving California city buildings a few months ago. “Theres just no way I can compete,” he said. Vending machines, a highly profitable market, have become an important new battleground in the soft-drink business, and Coca- Cola, through its bottlers, is by far the biggest and the most aggressive competitor. “Were in a period of intense competition between bottlers and full-line vending operators for the control of soft-drink vending machines,” said Elliott Maras, editor of the trade magazine Automatic Merchandiser. For consumers, the battle has led to greater availability of soft drinks at somewhat lower prices. But many Coke-vending-machine owners and distributors across the United States complain that the fight is not fair. They say that Coca-Cola, which owns 44 percent of Coca-Cola Enterprises and all the rights to popular brands like Coca-Cola, Diet Coke and Sprite, is using its dominant position to take business away from them. The power of Coca-Cola bottlers over distributors, they say, is further enhanced by a 1980 federal law that gives local bottlers exclusive rights to sell soft-drink brands in a certain territory. More often than not, in Cokes case, the local bottler is Coca-Cola Enterprises, which did $3.2 billion worth of business last year, according to an earnings report. The complaints have led to investigations and lawsuits in several states, people involved in the inquiries said. A spokesman for Coca-Cola Enterprises said the company played by the rules. “We deal with our customers in a fair and equitable manner,” said spokesman John Downs Jr., “creating value for them and satisfying the refreshment needs of our consumers.” He added, “It is our policy to fully comply with all laws and regulations applicable to our business operations.” Distributors who are accustomed to selling Coca-Cola products — which have a 43.9 percent market share in the United States — but are troubled by the presence of Coca-Cola Enterprises as a rival say that they cannot simply switch to selling other brands: Their investments, market demand and other competition prevent it. At the same time, they have no choice but to buy from the local bottler because Coca-Cola will penalize any bottler that sells to customers from outside its designated territories. As a result, say many smaller vending-machine owners and distribution companies, a bottler can raise prices at will and otherwise dictate the terms of business. “My opinion is, they overprice us in order to keep us in a less competitive position than they have,” said Ladd Little, who runs L.C. Vending, his familys company in San Antonio. Like McGee, he is a customer of Coca-Cola Enterprises, which controls the Coke bottling business in most of Texas. Little says that the price Coca-Cola Enterprises charges him is higher than what he can find elsewhere. “I buy a truckload a week,” he said. “I can buy it for less at the grocery store. But they wont allow that grocery store to sell it to me in quantity, either.” Several New York distributors say they are trying to organize to resist the competition from Coca-Cola Enterprises. “We just want them to sell us the product for the same prices that they sell it to themselves,” said one distributor, who spoke on the condition of anonymity. “Theres got to be something wrong with being the wholesaler, and the retailer, and being protected by the law.” Constance L.
